According to the American Motorcyclist Association (AMA), there are just two states without helmet requirements for any rider. Nineteen states plus the District of Columbia require the wearing of helmets for all riders and passengers. The remaining 29 states allow the motorcyclist to decide on helmet use once an age or experience level has been met.

The National Highway Traffic Safety Administration (NHTSA), the same government entity that bribed states into mandatory seat belt laws with the threat of reduced Federal road funds, is still trying to convince states to pass legislation requiring all motorcycle riders and passengers to wear helmets. The NHTSA has even suggested a need for national motorcycle helmet legislation.

More regulation is not what is needed. What is needed is common sense and education.

In many of the states that require helmets for all motorcyclists, one can often find, especially during summer months, the most egregious violations of ATGATT. It is not unusual to see a biker sporting a DOT helmet but wearing shorts and tennis shoes. Rock the Gear often holds seminars at rallies to educate riders on the importance of wearing all the gear, all the time. Hot exhaust pipes can burn bare legs and road rash is just as painful as burns.

It is essential that motorcyclists become educated not only in what protective gear can do but also to become educated in how to make sure that more regulations dont ultimately make motorcycling obsolete. Organizations such as ABATE and the AMA continually monitor pending legislation to ensure the riding public the freedom to ride.

Most reasonable, sane, intelligent adults will agree that wearing a helmet when riding a motorcycle is smart. However, those same reasonable, sane, intelligent adults are adults and should be able to decide for themselves whether or not to wear protective gear.

Motorcycling is risky and deciding to motorcycle is about risk management. Each rider must decide just how much risk they are willing to take.
