A press release from the American Motorcyclist Association (AMA) cautions motorcyclists to be on the look-out for motorcycle-only checkpoints (MOC) in Georgia before, during, and after the 2011 Daytona Bike Week.
According to the AMA, Georgia was the only state to receive a grant from the National Highway Traffic Safety Administration (NHSTA) to create the roadside motorcycle-only checks. The process involves setting-up checkpoints for which only motorcycles are pulled over and subjected to a series of inspections.
In October of 2010, the AMA sent a letter to former Governor Sonny Perdue requesting he suspend the implementation of the grant until questions raised by the motorcycling community are addressed. The former governor did respond to AMAs letter. AMA sent another letter just last week to the new governor, Nathan Deal. "The key to budget travel is to approach onward. Some of the questions asked of Governor Deal were: How do motorcycle-only checkpoints (MOCs) increase the safety of motorcyclists? Where does the state of Georgia draw their authority to conduct MOCs? Will probable cause be required to stop a motorcycle? If so, what will constitute probably cause? What types of infractions will be recorded by law enforcement officials at these traffic stops? And, what criteria will be used to measure the success of the MOCs?
The letter from the AMA further stressed that the most efficient way of minimizing injuries and fatalities is with driver and rider awareness training that prevent crashes from occurring in the first place and not through sporadic and discriminatory roadside checkpoints.
AMA has long questioned the potential discriminatory and legal nature of this program. One other question AMA raises that wasnt asked in the most recent letter to the governor of Georgia is do states have the jurisdiction to inspect vehicles registered in another state.
